How to hire migrants under new Accredited Employer Work Visa (AEWV) process?

The objective of the new AEWV process is to encourage businesses to train, upskill and hire New Zealand workers before they hire migrants. Therefore, you will need to establish through the new process that you will be a good employer for migrants and that no New Zealanders are available for the Job being filled. The criteria to satisfy Immigration New Zealand (INZ) requirements may vary depending on business or job types. You need to satisfy INZ that the business is sustainable and compliant. You are also required to make a commitment to provide support to the employee and declare that you will follow due process in relation to the employment.

Business Sustainability

You may need to meet one of these financial requirements:  You have not made a loss over the last 2 years; you have had a positive cash flow each month for the last 6 months; you have enough capital or external investment for your business to remain viable, or you have a credible 2-year plan to ensure your business remains viable. If the business is operating for less than 12 months, you will be asked to provide specific evidence.[1]

Confirmation of Compliance & Declaration of Commitments

Business intending to apply for AEWV) must be compliant with New Zealand immigration law, employment laws, and business regulations.[2] You also must not be bankrupt or subject to a No Asset Procedure. You will need to go through declarations for a number of commitments relating to the recruitment compliance; obligation to provide support for migrant settlement[3] and other related areas.

You need to provide details of business and the key people in your organisation.[4] Most applications will be assessed based on the declarations made during the application assessment and based on publicly available information or information held by the Ministry of Business, Innovation and Employment.

[1] Evidence of start-up capital or funding, cash-flow or revenue forecasts contracts for work, GST returns, PAYE returns.

[2] As a part of the application, you need to declare that the company, the employer, and those running the company are all compliant with New Zealand employment laws and regulations, and with the Immigration Act 2009.

[3] i.e., Giving your migrant workers specific information about working and living in New Zealand, and community services in their local area. You must tell them about getting an IRD number, industry training and qualification options that apply to them, relevant job or industry hazards, accommodation options and the cost of living, driving and driving licence information and public transport options, health services, Citizens Advice Bureau services, relevant community groups. You need to complete these settlement activities within a month from the day the migrant starts their employment contract.

[4] i.e., a business IRD number, an NZBN unless you are a foreign diplomatic mission, the full name, passport number and date of birth of key people in your business/organisation.”
